Notice of Purchaser Liability
Use of LION SEEDS seed indicates acceptance by buyer of the following terms. If Buyer does not accept these terms, buyer may return the seed for full credit.
Warranty and Limitation of Liability
LION SEEDS warrants that the seed in its packages/cans is labelled as required by law and will conform to the label. LION SEEDS MAKES NO OTHER WARRANTY OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. There is no assurance of seed or crop performance or freedom from disease (even if seed borne).
LIMITATION OF LIABILITY. THE EXCLUSIVE REMEDY FOR LOSS OR DAMAGE ARISING OUT OF THE SEED IS LIMITED TO RETURN OF THE PURCHASE PRICE OF THE SEED and BUYER MAY NOT RECOVER FROM SELLER OR LION SEEDS ANY OTHER DAMAGE, INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES, claimed under any legal theory, whether breach of contract, tort, strict liability, or otherwise.
Indemnification
By accepting seed, Purchaser agrees to defend and indemnify LION SEEDS from any claim asserted by any transferee of such seed who are notified of the terms and conditions as to LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTY, and NOTICE, in terms similar to those contained herein.
Contractual Arbitration
In addition to the terms and conditions regarding various state notices as set forth above, it is expressly provided herein that every purchaser of LION SEEDS products agrees that in the event of any dispute regarding the performance of such products, such dispute whether involving LION SEEDS, Authorised LION SEEDS Dealers, or both, shall be subjected to binding arbitration, such arbitration to be pursuant to the applicable terms and conditions of the then-existing regulations of the International Seed Federation relating to commercial disputes.
Varietal Descriptions and Illustrations
Descriptions and illustrations appearing in LION SEEDS catalogues and on labels represent our products as grown in LION SEEDS trials in selected areas. Appearance and performance may vary in other geographic regions and under different growing conditions. Please investigate whether differences may be expected in your growing area.
Notice to Purchaser Regarding Diseases
LION SEEDS makes no representation regarding the freedom of seedborne diseases and disclaims any liability relating to such diseases whether previously known to exist or not identified until this seed is grown.
